Terms & Conditions

Last Updated: 9/29/2026

These Terms & Conditions ("Terms") are a legal agreement between you and Smokin Anglers LLC ("Smokin Anglers," "we," "us," or "our"). They govern your access to and use of smokinanglers.com, your purchase of merchandise, your purchase or use of memberships, your registration for or participation in fishing trips, tournaments, meetups, workshops, and events, and other services that link to or incorporate these Terms.

By using the website, placing an order, purchasing or using a membership, registering for an activity, or otherwise using a Smokin Anglers service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the applicable website or service.

1.    About Smokin' Anglers

Smokin Anglers LLC is a New York limited liability company and a nationwide fishing club focused on fishing, outdoorsmanship, education, community, organized trips and events, entertainment content, and official club merchandise. Our website may describe current or planned destinations, target species, membership benefits, starting prices, content, and products. Information may change as conditions, availability, partners, seasons, regulations, and club programming change.

2.    Eligibility and Minors

You must be legally capable of entering into a binding agreement to make purchases, enroll in a paid membership, or book a trip in your own name. If you are under the age of majority where you live, a parent or legal guardian must complete the transaction and accept these Terms on your behalf.

Minors may participate in eligible club activities only when permitted by the applicable activity rules, operator requirements, fishing regulations, venue policies, and law. A parent or legal guardian may be required to attend, sign a waiver or release, provide emergency information, and remain responsible for the minor. Certain activities, locations, products, or conduct may be restricted by age. Smokin Anglers does not waive or alter any legal age requirement.

3.    Website Use and Accounts

You may use the website only for lawful personal purposes and in accordance with these Terms. If an account, member portal, checkout profile, or similar feature is offered, you are responsible for providing accurate information, maintaining the confidentiality of your credentials, and promptly notifying us of suspected unauthorized access.

You may not:

  • Use the website or services for fraud, unlawful activity, harassment, threats, impersonation, or conduct that infringes the rights of another person.

  • Attempt to gain unauthorized access to the website, accounts, servers, systems, networks, or data, or bypass security, access controls, rate limits, or technical restrictions.

  • Upload or transmit malware, harmful code, spam, deceptive content, or material that interferes with the website or another user’s experience.

  • Scrape, crawl, copy, extract, reproduce, or commercially exploit website content, member-only resources, pricing, databases, or media except as permitted by law or with our written permission.

  • Use Smokin Anglers names, logos, photographs, videos, trademarks, or other protected materials in a way that falsely suggests sponsorship, endorsement, or affiliation.

4.    Memberships

Membership Benefits

Smokin Anglers may offer annual, monthly, or other membership options. Membership benefits may include member-only content and resources, access to certain events or updates, priority support, member offers, or other benefits described on the website or at checkout. Benefits, schedules, availability, and participating partners may change over time. Membership does not guarantee availability of any particular trip, fishing destination, event, product, catch, species, discount, guide, or other benefit.

Membership Fees and Renewal

The membership page currently advertises an annual membership at $150 per year. If a membership is offered on an automatic-renewal or continuous-service basis, the checkout or enrollment flow will state the applicable price, billing frequency, renewal term, and cancellation method before you consent to recurring charges. You authorize the recurring charges only when you affirmatively enroll in the recurring plan presented to you.

Prices and membership options may change for future renewal periods as permitted by law. When legally required, we will provide advance notice of renewal or material changes and obtain any additional consent required for a price increase or other change. Taxes or other charges, if applicable, may be added as disclosed at checkout.

Cancellation

You may cancel an automatically renewing membership using the cancellation method made available for your plan or by contacting us at fish@smokinanglers.com if email cancellation is offered for the applicable membership. Cancellation stops future renewal charges after the current paid term unless otherwise required by law or stated in the plan terms. Canceling a membership does not automatically refund charges already incurred or create a prorated refund right unless the plan terms, a promotion, or applicable law provides otherwise.

If a payment fails, is reversed, or is disputed, we may suspend benefits while the payment issue is resolved. We may also suspend or terminate membership for fraud, abuse, material violations of these Terms or club rules, unsafe conduct, harassment, nonpayment, or unlawful activity. Where appropriate, we may provide notice and an opportunity to address the issue, but immediate action may be taken when reasonably necessary for safety, security, legal compliance, or protection of the club and its members.

5.    Fishing Trips, Meetups, Tournaments, and Events

Trip-Specific Terms Control

Each trip, meetup, tournament, workshop, or event may have additional terms relating to price, deposits, payment deadlines, cancellation, refunds, itinerary, weather, transportation, lodging, required gear, licenses, waivers, age limits, guest rules, safety, catch limits, prizes, or conduct. Those trip-specific or event-specific terms are incorporated into these Terms. If a trip-specific term conflicts with a general provision in these Terms, the trip-specific term controls for that activity.

No Guarantee of Catch or Conditions

Fishing is inherently variable. Weather, water conditions, seasonality, fish behavior, regulations, equipment, operator decisions, safety considerations, and other factors affect every outing. Smokin Anglers does not guarantee that you will catch fish, catch a particular species or size, retain a fish, receive a particular fishing position, experience specific conditions, or achieve any tournament result. Destinations, target species, times, vessels, guides, schedules, and itineraries may change when reasonably necessary.

Licenses and Legal Compliance

Participants are responsible for complying with all applicable fishing, boating, wildlife, conservation, customs, travel, and local laws. Unless a written trip description expressly states that a license, permit, stamp, visa, passport service, or similar requirement is included, each participant is responsible for obtaining and carrying the licenses, permits, identification, travel documents, and approvals required for the activity.

Bag limits, size limits, seasons, catch-and-release rules, protected species rules, tournament rules, and operator instructions must be followed. Smokin Anglers may remove or disqualify a participant from an activity for unlawful, unsafe, disruptive, unsportsmanlike, or abusive conduct, subject to any rights required by law.

Health, Safety, and Assumption of Risk

Fishing, boating, travel, outdoor activities, tournaments, and related events involve risks that may include changing weather, waves, currents, slippery surfaces, hooks, knives, wildlife, sun exposure, heat or cold, seasickness, vehicle or vessel travel, equipment failure, falls, collision, drowning, remote locations, delayed medical care, and other foreseeable or unforeseeable hazards. By voluntarily participating, you acknowledge that these activities involve inherent risks.

You are responsible for assessing whether you are physically and medically able to participate, following captain, guide, crew, venue, and safety instructions, using required safety equipment, behaving responsibly, and informing the applicable operator of relevant limitations or assistance needs when appropriate. Smokin Anglers may require a separate assumption-of-risk agreement, release, or waiver for particular activities. Any such document will apply according to its terms and applicable law.

Third-Party Operators

Trips and events may involve independent charter captains, guides, marinas, lodges, hotels, transportation companies, outfitters, venues, restaurants, insurers, or other third parties. Unless we expressly state otherwise in writing, those third parties are independent providers and are responsible for the services they directly provide. Their own terms, waivers, safety rules, cancellation policies, and privacy policies may apply.

Weather, Safety Changes, and Cancellations

Safety decisions may be made by Smokin Anglers or the applicable captain, guide, venue, or operator. An activity may be delayed, shortened, relocated, rescheduled, modified, or canceled because of weather, water conditions, mechanical problems, closures, emergencies, travel disruptions, governmental orders, regulatory changes, insufficient participation, or other circumstances.

Refunds, credits, rescheduling rights, and responsibility for nonrefundable travel costs are governed by the terms disclosed for the particular trip or event. Unless we expressly agree otherwise in writing, participants are responsible for their own airfare, lodging, ground transportation, travel insurance, passport or visa costs, missed connections, and other personal travel expenses.

6.    Merchandise, Orders, and Checkout

Product Information and Availability

We make reasonable efforts to display products, descriptions, photographs, sizes, colors, prices, and availability accurately. Screen settings, production variations, supplier changes, photography, and other factors may cause differences in appearance. We do not guarantee that every product description, image, price, or inventory status is error-free or current at all times.

We may limit quantities, reject or cancel orders, correct errors, update product information, or discontinue products. If we cancel a paid order because we cannot fulfill it, we will issue an appropriate refund for the canceled item or order.

Pricing, Taxes, and Payment

Prices are stated in U.S. dollars unless otherwise indicated. Shipping charges, taxes, and other applicable fees are displayed or calculated as part of checkout when required. By placing an order, you represent that you are authorized to use the selected payment method and authorize the applicable charges. Payment processing may be provided by a third-party payment service, and its terms may also apply.

Shipping, Returns, and Exchanges

Estimated shipping or delivery dates are estimates and are not guaranteed. Delays may occur because of carriers, weather, address issues, product availability, production time, customs, or other circumstances outside our control.

Any separate shipping, return, exchange, or refund policy displayed on the website or during checkout is incorporated into these Terms. If no separate policy addresses a particular merchandise issue, contact fish@smokinanglers.com before returning an item so we can review the request and provide instructions. Except where required by law, unauthorized returns may not be accepted, and return shipping may be the customer’s responsibility.

7.    Promotions, Contests, and Tournaments

Promotions, giveaways, competitions, fishing challenges, and tournaments may be governed by separate official rules, eligibility requirements, scoring methods, prize terms, deadlines, waivers, or disclosures. Those rules control the applicable promotion or event. Void where prohibited. We may disqualify entries or participants for fraud, tampering, cheating, unsafe conduct, violation of rules, or conduct that undermines the integrity of the activity, subject to applicable law.

8.    Community Conduct

Smokin Anglers is intended to support a respectful fishing community. When interacting with members, staff, guides, guests, partners, or other participants, you agree not to engage in harassment, threats, violence, discrimination prohibited by law, stalking, bullying, intentional property damage, dangerous conduct, cheating, theft, or repeated disruption of club activities. Participants must respect conservation rules, private property, marina and vessel rules, local communities, and other anglers.

We may establish additional club or event rules. Serious or repeated violations may result in removal from an event, suspension of privileges, cancellation of future participation, or termination of membership, subject to applicable law and any specific membership terms.

9.    Photographs, Video, Testimonials, and User Content

If you voluntarily submit photographs, video, reviews, testimonials, comments, captions, fishing reports, or other content to Smokin Anglers for publication or promotional use, you represent that you have the rights necessary to submit that content and that our permitted use will not violate another person’s rights.

Unless different terms are agreed in writing, by submitting content for publication, you grant Smokin Anglers a nonexclusive, worldwide, royalty-free license to host, reproduce, display, distribute, adapt for formatting, and use that content in connection with our website, social channels, club communications, and promotion of Smokin Anglers. You retain ownership of your content. You may contact us to request removal of previously published user content, although we may retain archival, legal, backup, or previously distributed copies where removal is not reasonably practicable or legally required.

Smokin Anglers may also photograph or record public-facing portions of club trips and events. Additional notice, releases, or consent may be used where appropriate. See our Privacy Policy for more information about personal information contained in media.

10.    Intellectual Property

The website and its original content, branding, logos, graphics, photographs, video, text, designs, layout, software, compilations, and other materials are owned by or licensed to Smokin Anglers and are protected by intellectual property laws. "Smokin Anglers" and associated names, logos, and branding may be protected trademarks or service marks. Except for limited personal use of the website, no license is granted to copy, reproduce, distribute, modify, sell, publicly display, create derivative works from, or commercially exploit protected materials without written permission from the rights holder.

11.    Copyright Complaints

If you believe material on our website infringes your copyright, please contact fish@smokinanglers.com with enough information for us to identify the work you claim is infringed, locate the material at issue, understand your basis for the complaint, and contact you. We may request the additional information required by applicable copyright law before acting on a notice.

12.    Third-Party Websites and Services

The website may link to third-party websites, social media pages, videos, booking services, payment tools, maps, travel resources, or other services. Links are provided for convenience and do not necessarily mean that Smokin Anglers controls, operates, endorses, or guarantees the third party. Your dealings with a third party are between you and that party and may be governed by separate terms and privacy policies.

13.    Educational and Informational Content

Fishing tips, techniques, destination information, species information, gear discussions, videos, articles, classes, workshops, and similar materials are provided for general educational and entertainment purposes. Conditions, regulations, equipment, and safe practices vary by location and activity. You remain responsible for confirming current laws, manufacturer instructions, operator requirements, and conditions before acting on information from our website or community.

14.    Disclaimers

To the maximum extent permitted by law, the website, content, membership benefits, and general online services are provided on an "as is" and "as available" basis. Smokin Anglers disclaims warranties that may otherwise arise by law, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the extent those warranties may legally be disclaimed.

We do not warrant that the website will be uninterrupted, error-free, secure, or free of harmful components, or that website content, prices, trip information, availability, conditions, or other information will always be complete, current, or accurate. Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.

15.    Limitation of Liability

To the maximum extent permitted by law, Smokin Anglers LLC and its owners, officers, employees, contractors, agents, and affiliates will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages, or for lost profits, lost data, lost opportunity, or similar losses arising from or relating to the website or general online services, even if advised that such damages could occur.

For claims arising from a product, membership, trip, or event, any additional limitation or allocation of risk disclosed in the applicable order, booking terms, waiver, or third-party operator terms may also apply. To the maximum extent permitted by law, smokin anglers’ aggregate liability for a claim relating to a specific purchase or service will not exceed the amount you paid directly to smokin anglers for that purchase or service during the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, the limitations above apply only to the extent permitted by law. Nothing in these Terms limits liability that cannot legally be limited, including liability that applicable law requires to remain available.

16.    Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Smokin Anglers LLC and its owners, officers, employees, contractors, agents, and affiliates from third-party claims, liabilities, damages, losses, and reasonable costs arising from your unlawful conduct, your material breach of these Terms, your violation of another person’s rights, or content you submit that infringes or misappropriates another person’s rights. This provision does not require indemnification for conduct for which indemnification is prohibited by law.

17.    Suspension and Termination

We may restrict or terminate access to the website or a service when reasonably necessary to address fraud, security threats, unlawful activity, nonpayment, material breach of these Terms, infringement, harassment, dangerous behavior, abuse of members or staff, interference with operations, or legal requirements. Termination does not eliminate payment obligations or other provisions that by their nature should survive, including intellectual property, disclaimers, limitations of liability, indemnification, dispute provisions, and rights relating to prior transactions.

18.    Force Majeure

Smokin Anglers will not be responsible for delay or failure to perform caused by events beyond our reasonable control, including severe weather, storms, wildfire, flood, natural disaster, public health emergencies, war, terrorism, civil unrest, labor disruptions, utility or communications failures, government action, transportation disruption, vessel or equipment unavailability, venue closure, supplier failure, or similar events. This section does not eliminate refund or other rights that applicable law expressly requires.

19.    Changes to Services and These Terms

We may update the website, membership benefits, merchandise offerings, trip schedules, content, and other services. We may also revise these Terms from time to time. The updated Terms will state the date of the latest revision. Where required by law, we will provide additional notice or obtain consent before a material change applies to an existing recurring membership or other ongoing consumer relationship. Changes do not retroactively alter completed transactions unless permitted by law and appropriately disclosed.

20.    Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except to the extent another law must apply. Before filing a formal claim, we encourage you to contact fish@smokinanglers.com so the parties can try in good faith to resolve the issue informally.

Subject to any law that gives you a nonwaivable right to bring a claim elsewhere, disputes arising from these Terms or services provided directly by Smokin Anglers may be brought in a court of competent jurisdiction in New York. Nothing in this section prevents either party from seeking appropriate relief in small claims court where the claim qualifies, or from seeking urgent injunctive relief where legally available.

21.    General Terms

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be enforced to the greatest extent permitted by law or, if necessary, severed. Our failure to enforce a provision is not a waiver of that provision. You may not assign your rights or obligations under these Terms without our written consent, except where applicable law provides otherwise. We may assign these Terms in connection with a merger, reorganization, sale of assets, or other business transaction.

These Terms, together with the Privacy Policy and any applicable order terms, membership disclosures, trip or event terms, rules, waivers, and policies referenced at checkout, constitute the agreement relating to the applicable service. If separate written terms expressly state that they override part of these Terms, the separate written terms control for that specific subject.
